These Terms govern your access to Debuted, a United States online marketplace for original artwork. By using Debuted, you agree to these Terms and the policies incorporated into them. If you do not agree, do not use the service.
You must be at least 18 years old and legally able to enter a contract to create an account, buy, or sell. Sellers must be located in the United States at launch. Buyers may create accounts worldwide, but delivery is limited to destinations offered by each seller.
You are responsible for accurate account information, safeguarding your credentials, and activity under your account. Debuted may suspend access to protect users, investigate misuse, comply with law, or enforce these Terms.
Debuted operates the marketplace and is the merchant of record for buyer payments. Debuted processes the buyer charge on its platform account, calculates applicable tax through Stripe Tax, and transfers eligible sale proceeds to the seller through Stripe Connect after shipment with tracking. Artists remain the sellers and creators of their works and are responsible for descriptions, authenticity, packaging, shipment, and compliance with law.
A listing is an invitation to purchase, not a guarantee of availability. An order is accepted when payment succeeds and inventory is confirmed. Debuted may cancel or refund an order when inventory is unavailable, fraud is suspected, the transaction violates policy, or the law requires it.
Prices are displayed in U.S. dollars. Buyers pay the item price, shipping, and applicable taxes shown at checkout. Debuted generally charges sellers a 17% platform fee on the item subtotal. Approved sellers receive a 0% platform fee for their first 90 days unless a disclosed seller-specific override applies. The fee in effect at the time of an order is recorded with that order.
Debuted bears payment-processing fees out of its platform fee. Sellers are responsible for their own income, business, and other taxes. Stripe controls identity verification and payout timing after Debuted transfers proceeds.
Each listing states its shipping destinations, handling time, shipping charge, and either a 14-day return policy or final-sale status. The Buyer Returns Policy is part of these Terms. Buyers pay return shipping unless an item is not as described, in which case the seller pays. Debuted may mediate and decide marketplace disputes based on the listing, communications, tracking, and other evidence.
Sellers retain ownership of artwork and uploaded content. By uploading content, you grant Debuted a worldwide, non-exclusive, royalty-free license to host, reproduce, resize, display, distribute, and promote that content for operating and marketing the marketplace. This license ends when content is removed, except for cached copies, completed-order records, and prior marketing uses.
Debuted names, branding, software, and site design are owned by Debuted or its licensors. No purchase transfers copyright in an artwork unless the seller expressly agrees in writing.
To the fullest extent permitted by law, Debuted is provided “as is” and “as available.” Debuted does not warrant uninterrupted service, that every listing is authentic or accurately represented, or that users will complete a transaction. Rights that cannot legally be disclaimed remain in effect.
To the fullest extent permitted by law, Debuted and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits or data. Debuted’s aggregate liability arising from the service will not exceed the greater of $100 or the fees Debuted received from you during the 12 months before the claim. These limits do not apply where prohibited.
You will defend and indemnify Debuted and its affiliates against third-party claims arising from your content, transactions, breach of these Terms, or violation of law or another person’s rights, to the extent permitted by law.
These Terms are governed by United States law and the law of the state where Debuted’s legal entity is organized, without regard to conflict-of-law rules. The specific entity, address, venue, and dispute-resolution terms must be finalized by counsel before launch. We may update these Terms prospectively and will post a new last-updated date and provide additional notice when legally required.
